1. Agreement to these Terms
These Terms of Service govern your access to and use of Monario, including monario.app, the Monario web app, and related services. By creating an account, accessing, or using Monario, you agree to these Terms and to our Privacy Policy.
If you do not agree, do not use Monario.
2. What Monario does
Monario is a budgeting and personal finance organization tool. It may allow users to create accounts, manually enter transactions, import CSV files, organize budgets, categorize spending, review dashboards, and track financial information.
Monario is not a bank, broker, financial advisor, credit counsellor, accountant, tax advisor, or investment advisor.
3. No financial, legal, tax, or investment advice
Monario provides tools and information for personal organization only. Any budgets, summaries, insights, categories, charts, forecasts, or calculations are informational and may be incomplete or inaccurate.
You are responsible for your own financial decisions. You should verify information before relying on it and consult qualified professionals for financial, legal, tax, investment, or accounting advice.
4. Eligibility
You must be at least 14 years old to use Monario. If you are using Monario on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
5. Account registration and security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate account information and to notify us promptly if you suspect unauthorized access or a security issue.
6. Your data and content
You may enter, upload, import, or generate content in Monario, including financial account information, transactions, budgets, notes, categories, and CSV imports. You retain ownership of your content.
You grant Monario a limited right to host, process, transmit, display, back up, secure, and use your content as needed to provide, maintain, troubleshoot, protect, and improve the service.
You are responsible for the accuracy, legality, and backup of the data you upload or enter into Monario.
7. CSV imports
You are responsible for ensuring that imported files are accurate and that you have the right to upload them. Monario may provide mapping, parsing, categorization, and duplicate-detection tools, but we do not guarantee that imports will be error-free.
You should review imported transactions before relying on them.
8. Acceptable use
You agree not to:
- Use Monario for unlawful, fraudulent, abusive, or harmful purposes.
- Attempt to access another user’s account or data.
- Interfere with, overload, reverse engineer, scrape, or attack the service.
- Upload malware, harmful code, or files that you do not have the right to use.
- Bypass security controls, usage limits, authentication, or access restrictions.
- Use Monario to store or process highly sensitive information that the service is not designed to handle.
9. Free tier, beta features, and future paid services
Monario may offer a free tier, beta features, trials, or experimental functionality. We may change, limit, suspend, or discontinue free or beta features at any time.
If Monario introduces paid plans, the applicable price, billing terms, renewal terms, cancellation terms, taxes, and refund rules will be shown before purchase. Paid features should not be considered active until billing terms are published and accepted.
10. Third-party services
Monario may rely on third-party providers for hosting, authentication, database, analytics, email, payment processing, support, security, and other infrastructure. Your use of third-party integrations may also be subject to those providers’ terms and policies.
We are not responsible for third-party services that we do not control.
11. Availability and changes
We aim to provide a reliable and useful service, but Monario may be unavailable, interrupted, delayed, or changed from time to time. We may update, modify, suspend, or discontinue any part of the service at any time.
12. Intellectual property
Monario, including its name, logo, design, software, interface, text, graphics, and other materials, is owned by Monario or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership of Monario intellectual property to you.
13. Feedback
If you submit ideas, suggestions, bug reports, or feedback, you allow us to use them without restriction or compensation, while you retain ownership of any underlying rights you may have.
14. Termination
You may stop using Monario at any time. We may suspend or terminate your access if you violate these Terms, create risk or harm, or if we are required to do so by law.
After termination, some sections of these Terms will continue to apply, including sections about ownership, disclaimers, limitation of liability, and dispute terms.
15. Disclaimers
Monario is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, and error-free operation.
16. Limitation of liability
To the maximum extent permitted by law, Monario and its owners, employees, contractors, suppliers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or financial opportunity.
To the maximum extent permitted by law, our total liability for any claim relating to Monario will not exceed the greater of: (a) the amount you paid to Monario in the 12 months before the claim, or (b) CAD $100.
17. Indemnity
You agree to defend, indemnify, and hold harmless Monario from claims, damages, liabilities, losses, and expenses arising from your use of the service, your content, your violation of these Terms, or your violation of law or third-party rights.
18. Governing law
These Terms are governed by the laws of the Province of Québec and the federal laws of Canada that apply there, without regard to conflict-of-law rules. The courts located in Québec will have jurisdiction, unless applicable consumer protection law gives you the right to bring a claim elsewhere.
19. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will provide notice through the website, app, email, or another reasonable method. Continued use of Monario after the effective date of updated Terms means you accept the updated Terms.
